The Namibian Competition Commission (NaCC) is established in terms of the Competition Act (Act No. 2 of 2003). The Commission is looking for a dynamic, hard-working, proactive and forward-thinking individual to assist the Commission in achieving its strategic objectives as defined in its Strategic Plan. Senior Analyst: Legal – Enforcement, Exemptions & Cartels
Job purpose:
Reporting to the Director: EEC, this is a specialist position responsible to assist the Commission in the performance of its core functions set out in Chapter 3 on the Namibian Competition Act (i.e. Restrictive Business Practices).
Key Responsibilities:
- Receive instructions for legal investigations from the Director.
- Receive and assess complaints and matters alleged as restrictive practices and abuse of dominance.
- Investigate, compile investigative reports and make recommendations to the Board of Commissioners on findings in re spect of alleged restrictive business practices.
- Investigate contraventions of the Chapter 3 of the Competition Act and assist legal representatives of the Commission in bringing and opposing applications to courts.
- Assess and screen all facts and data provided in complaints and exemption applications.
- Research and analyse legal implications of competition law matters and provide findings and recommendations accordingly.
- Prepare written legal opinions and documentation when required and report all findings of legal investigations in the prescribed manner.
- Liaise with external experts to obtain advice when necessary as instructed by the Director.
- Assist in drafting internal policies, procedures and guidelines in relation to restrictive business practices.
- Recommend changes to the law in relation to restrictive business practices.
- Scrutinise the investigations, research findings, legal advice and opinions of team.
- Supervise the monitoring of compliance with decisions of the Commission.
- Induction and training of team.
Education, Competencies & Skills Requirements:
- Recognised Honours Degree in Law with Commercial Law or Competition Law as subjects.
- At least 5 years’ experience in the legal field. Detailed knowledge of relevant legislation and legal practice.
- Experience at a supervisory level for more than 2 years, will be an added advantage.
- Having been admitted as a Legal Practitioner of the High Court of Namibia for not less than 2 years.
- Understanding of competition matters.
- Detailed knowledge of relevant legislation and legal practice.

- Verbal communication and presentation skills.
- Research / investigative competencies.
- Economic insight.
- Report and legal opinion writing skills.
