Estate and Liquidation Specialist (SP6) Legal Collections Department

Introduction
Responsible for effective and efficient management and administration of legal collection activities of the Branch in compliance with the Bank’s credit policy and procedures in order to manage the performing and non-performing loans.

KEY PERFORMANCE AREAS (KPAS)

1. Financial Management
• Assist the Manager: Legal Debt Recovery with the planning and execution of financial targets related to legal collections.

2. Legal Collections
2.1 Estate Late Account
• Managing all performing and non-performing accounts as per the BID 2 regulations
• Institute claims against estate late accounts with the executor/agent on behalf of the Bank
• Assist with driving the process of the realization of security

2.2. Liquidation and Sequestration Accounts:
• Responsible for preparing liquidation claims in line with the Insolvency Act and Companies Act
• Submission of claims at the office of the Master of the High Court and inspecting any other claims
• Liaising with liquidators/trustees ensuring the realization of security as secured creditor;

2.3. Judicial Management:
• Judicial management and work closely with relevant stakeholders.

2.4. Business Rescue:
• Management of the legal process in Court (if applicable) for business rescue implementations.

2.5 Realisation of securities
• Realisation of all collateral securities ceded to the Bank in line with the Bank’s policy and procedures

2.6 Auctions
• Ensure that auctions are conducted in liaison with other internal and external stakeholders.

2.7 Write-offs processing and Recording
• Overall responsible for monitoring of accounts with no recovery possibilities to ensure that they are written-off in compliance with the Bank’s policies and procedures, as well as applicable legislation.

2.8 Government Gazette:
• Review government gazette on a weekly basis, section 29, section 35 (5) notices in respect of estate late, the appointment of liquidator/trustee, liquidation and distribution accounts lying open for inspection, and notice to surrender.

3. Relationship Management
• Responsible for building and enhancing long-term working relationships with both internal and external stakeholders including clients, e.g. attorneys, branches, etc.

4. Management of Collateral Documentation
• Management and administration of agreements and collateral documentation in compliance with the Bank’s policies and procedures.

5. Compliance, Risk and Support

• Management and administration of legal collection internal processes and procedures in order to ensure compliance with the Bank’s risk framework to minimize risk
6. People Management
• Provide management and leadership capability to the team.
• Develop and re-enforce a performance culture in the team.

7. Routine Administration
Management and control of all routine administrative activities related to the legal collection in the branch in compliance with the Bank’s policies, procedures, rules, and regulations.

Experience/Knowledge & Skills

· At least 3-5 relevant banking experience of which 2 years should be at the supervisory level and 3 years’ experience in a legal collection environment.
· Knowledge and experience of estates, liquidation, judicial management, and business rescue

Qualification

· LLB Degree
· A qualification in estates, liquidation, judicial management and business rescue legal field will be an added advantage.
